Before you are allowed access to the Community Injury Surveillance System (“CISS”) developed by the Occupational Safety and Health Council (“OSHC”) and any webpages thereof, you are required to indicate whether you agree to be bound by the terms and conditions set out below and any changes and amendments made thereto from time to time as the OSHC thinks fit.

A. Use of the CISS

Access to the CISS via a registered account (the “Registered Account”) is intended solely for the use by your organization or company to monitor the trend of injury cases. It is not intended for use by any other person or organization, whether within or outside Hong Kong, or for any other purpose. You agree not to allow your Registered Account and/or the CISS to be used by any other person or organization or for any other purpose without the prior written consent of the OSHC.

You agree to, and shall procure your employees to, use the CISS in accordance with the guidance materials for users available on the OSHC website and any applicable laws. You acknowledge that any information, data, statistics, graphs, analysis, reports, documents, products, materials, etc. (the “Analysis”), generated by the CISS, in whatever form or medium, do not constitute professional advice and should not be relied upon in that regard. Persons using the CISS and having access to any such Analysis generated by the CISS will obtain appropriate professional advice from their own professional advisers where necessary.

You understand and agree that the CISS and any services or facilities in relation thereto may be withdrawn, edited or amended at any time without prior notice to you at the sole and absolute discretion of the OSHC. The availability for use of the CISS remains, at all times, subject to the final and absolute discretion of the OSHC.

You further understand and agree that any information which you input into the CISS and any Analysis generated by the CISS may be used by the OSHC for research purposes. However, the name of your organization or company or the names of the injured persons will not be identified if such information, Analysis or information deriving from such information or Analysis is included in any documents subsequently published by the OSHC as a result of any related research.

B. No Warranty or Representation

The CISS is provided by the OSHC for use by your organization or company on an “as is” basis without warranty or representation of any kind, express or implied. No warranty or representation of any kind, including but not limited to, security, accuracy, fitness for a particular purpose is given in conjunction with the CISS and any related webpages, facilities, materials, etc. or any Analysis generated by the CISS.

C. Intellectual Property Rights

The CISS and any related webpages, materials, etc., thereof are protected by copyright and other intellectual property rights (where applicable). You acknowledge that the OSHC is the owner of the intellectual property rights subsisting in the CISS and any related webpages, materials, etc., and you will not modify, reproduce, store in a retrieval system, transmit (in any form or by any means), copy, disseminate, make adaption to, or otherwise deal with the CISS and any related webpages, materials, etc., or any part of it, without the prior written consent of the OSHC.

D. Limitation of Liability

You understand and agree that to the extent permitted by law, the OSHC shall not be liable to your organization or company or any other person for, including but not limited to, any direct or indirect, special, incidental or consequential, losses arising from or in connection with the CISS (and any related webpages, facilities, materials, etc.), the use of the CISS or the use or reliance on the Analysis generated by the CISS.

E. Internet Communication

As the use of the CISS requires access to and the use of the Internet, you understand that information transmitted through the Internet may not be completely secure or reliable and that such insecurity and unreliability are beyond the control of the OSHC. Due to traffic congestion and the public nature of the Internet, transmission of information through the Internet may be subject to delays, errors, interruptions, transmission blackouts, leakage of information, and this may further result in errors or inaccuracies in the processing of information or data by the CISS and in any Analysis produced by the CISS. You understand that the OSHC accepts no liability for any loss arising directly or indirectly (including consequential loss) in relation thereto.

F. Hyperlinks to other websites

Any hyperlinks from this site, the CISS and/or the OSHC website (and any related webpages thereof) are for your convenience only. The inclusion of hyperlinks does not imply any endorsement by the OSHC of any information, material and services offered through such sites and the access to and use of such other websites is at the user's own risk. The OSHC is not responsible for the contents available on such other websites to which this site, the CISS and/or the OSHC website (and any related webpages thereof) is linked and accepts no liability for any loss arising directly or indirectly (including consequential loss) from the accuracy or otherwise of the materials or information contained in such other websites.

      阁下同意并促使阁下的雇员根据职安局网站所示为使用者而设的指引材料及任何适用法律使用社区伤害监察系统。阁下确认社区伤害监察系统以任何形式或媒介产生的任何资料、数据、统计、图表、分析、报告、文件、产品、材料等('分析')，均不构成专业意见，且不应就此而被用作依据。使用社区伤害监察系统及可存取社区伤害监察系统产生的任何上述分析的人士将在必要时自行向其专业顾问获取适当的专业意见。
       阁下明白并同意社区伤害监察系统及与之有关的任何服务或设施可不时按职安局的独有及绝对酌情权随时予以取消、修改或修订，而无须事先通知阁下。社区伤害监察系统可供使用的情况时刻均受限于职安局的最终及绝对酌情权。
       阁下并且明白及同意阁下在社区伤害监察系统及社区伤害监察系统所产生的任何分析中提供的任何资料，均可能被职安局用作研究用途。惟若有关资料、分析或从有关资料或分析中产生的资料被载于职安局期后因任何相关研究而公布的任何文件中，则阁下机构或公司的名称或伤者名称将不会被披露。
      

B. 不予保证或陈述

      职安局向 贵机构或公司提供的社区伤害监察系统作'按现状'使用，而不作任何类型的明文或隐含的保证或陈述。职安局不会就社区伤害监察系统及其任何相关的网页、设施、材料等或社区伤害监察系统产生的任何分析，作任何类型(包括但不限于安全性、准确性、作特定用途的合适性)的保证或陈述。
      

C. 知识产权权利

      社区伤害监察系统及其任何相关网页和材料等均受版权及其他知识产权权利(如适用)所保障。阁下确认职安局为社区伤害监察系统及任何相关网页和材料等当中存续的知识产权权利的拥有人，且阁下将不会在未经职安局的事先书面同意下，修改、复制、储存于检索系统、传送(以任何形式或以任何方式)、复印、发布、改编或以其他方式处置社区伤害监察系统及任何相关网页和材料等或其任何部份。
      

D. 责任限制

      鉴于使用社区伤害监察系统须存取及使用互联网，阁下明白透过互联网传送资料可能并不完全安全或可靠，而有关不安全性及不可靠性均非职安局可控制。透过互联网传送资料可能会因传送阻塞及其公开性质而导致延误、错误、干扰、传送中断、资料外泄，且可能进一步导致社区伤害监察系统处理的资料或数据及社区伤害监察系统作出的任何分析出错或不准确。阁下明白职安局不会就其直接或间接引致的任何损失(包括相应而生的损失)承担责任。
     

F. 前往其他网站的超连结
